Historical place. The jurisdiction of the Supreme Court of Bangladesh has been provided for in the Constitution of the People’s Republic of Bangladesh. Article 94(1) of the Constitution provides that there shall be Supreme Court for Bangladesh comprising the Appellate Division and the High Court Division. These two Divisions of the Supreme Court have separate jurisdictions. The sources of this jurisdiction, apart from the Constitution, are general laws (Acts of Parliament) of the country. Jurisdiction of the Appellate Division The Constitution has conferred on the Appellate Division the following jurisdictions: a. Appellate Jurisdiction: Article 103 of the Constitution provides that the Appellate Division shall have jurisdiction to hear and determine appeals from judgments, decrees, orders or sentences of the High Court Division. An appeal to the Appellate Division shall lie as of right where the High Court Division- (a) certifies that the case involves a substantial question of law as to the interpretation of the Constitution; or (b) has sentenced or confirmed the sentence of a person to death or to imprisonment for life; or (c) has imposed punishment on a person for contempt of that division; and in other cases if the Appellate Division grants leave to appeal and also pursuant to Acts of Parliament. b. Issue and execution of processes of Appellate Division: Under article 104, the Appellate Division shall have power to issue such directions, orders, decrees or writs as may be necessary for doing complete justice in any cause or matter pending before it, including orders for the purpose of securing the attendance of any person or the discovery or production of any document. c. Power of Review: Article 105 provides that the Appellate Division shall have power, subject to the provisions of any Act of Parliament and of any rules made by the Division, to review any judgment pronounced or any order made by it. Part IV, Order XXVI of the Supreme Court of Bangladesh (Appellate Division) Rules, 1988 deals with the power and procedural matters of review of the Appellate Division. d. Advisory Jurisdiction: Article 106 of the Constitution provides that if at any time it appears to the President that question of law has arisen, or is likely to arise, which is of such a nature and of such public importance that it is expedient to obtain the opinion of the Supreme Court upon it, he may refer the question to the Appellate Division for consideration and the Division may, after such hearing as it thinks fit, report its opinion thereon to the President. e. As of April 2019 there are 7 Justices in Appellate Division and 92 (74 are permanent and 18 are additional) in High Court Division. Structure Supreme Court of Bangladesh is divided into two parts. First, the Appellate Division and second is the High Court Division. The High Court Division hears appeals from lower courts and tribunals; it also has original jurisdiction in certain limited cases, such as writ applications under Article 102 of the Constitution of Bangladesh, and company and admiralty matters. The Appellate Division has jurisdiction to hear appeals from the High Court Division.[2][3] The Supreme Court is independent of the executive branch, and is able to rule against the government in politically controversial cases. Judgments of Supreme Court of Bangladesh As per Article 111 of the Constitution of Bangladesh, 1972, the Supreme Court judgments have binding effects and the article provides that the law declared by the Appellate Division shall be binding on the High Court Division and the law declared by either division of the Supreme Court shall be binding on all courts subordinate to it. These judgements are usually digested in the Bangladesh Supreme Court Digest. There are also many law reports which publish the judgments and orders of the Supreme Court. Criticism Albeit Bengali is the only state language of Bangladesh in accordance with the article 3 of the Constitution of Bangladesh and English literacy rate is low, the verdicts given by the judges at the Supreme Court of Bangladesh are always in English. Sheikh Hasina, the incumbent and longest serving Prime Minister of Bangladesh, suggested that the judges should deliver their verdicts in Bengali and, later on if need be, the verdicts could be translated in English.[6] Muhammad Habibur Rahman, a former Chief Justice of Bangladesh stated that if justice is a virtue and a service to the people, then verdicts should be given in Bengali. He also stated that if the people of the country want that all works in the Supreme Court must be operated in Bengali, then the representatives of the people in the Jatiya Sangsad (Parliament of Bangladesh) must pass and implement law to ensure the use of Bengali in the Supreme Court.

High Court originated historically from the High Courts Act of 1861. During the east india company rule there was a Supreme Court in Calcutta representing the British crown with its jurisdiction over all Europeans living in Bengal and all native citizens of Calcutta only. The highest court of the company's Bengal kingdom was the Sadar Adalat which had two divisions, Sadar Diwani Adalat and Sadar Nizamat Adalat. The Sadar Adalat represented the Company. The judges of the Sadar Adalat were the members of the Covenanted Civil Service. Though the judges of the Adalat consisted of Europeans, the laws that they administered were essentially Indian. The Sadar Adalat had no jurisdiction over the Europeans nor the Supreme Court over the natives outside of Calcutta. Such a duality of jurisdiction was abolished with the abolition of the East India Company in 1858 when the Crown took over the responsibility of administering British India.
